Letter to Cabinet Secretaries and Ministers – Statutory Framework on Restraint and Seclusion

The Children and Young People’s Commissioner Scotland, alongside the Scottish Human Rights Commission, The Promise Scotland, and the Equality and Human Rights Commission, has urged the Scottish Government to establish a unified statutory framework on restraint and seclusion across all child care settings. Despite previous appeals, the Government’s response maintains a fragmented, setting-specific approach, raising concerns about inconsistent legal protections. Highlighting gaps in oversight, particularly in secure education and mental health settings, the letter calls for coordinated legislative action, aligning upcoming bills to ensure comprehensive safeguards. The signatories seek a firm Government commitment by 14 March 2025.
