Commissioner commends Justice Secretary’s assurance on Crown immunity


Recommendations made in report

The Children and Young People’s Commissioner welcomes the Justice Secretary’s assurances in the Scottish Parliament that she will take forward all of the recommendations made by Sheriff Collins KC in his fatal accident inquiry report into the deaths of William Lindsay and Katie Allan. 

Angela Constance, Justice Secretary, also said she will pursue the issue of removing Crown immunity in cases of deaths in custody. 

This office has previously called for the Scottish and UK governments to remove Crown immunity for the Scottish Prison Service and Scottish Ministers, after the deaths of William and Katie. 

The Justice Secretary told MSPs that she would continue to pursue the issue of immunity with the UK Government. Again, we support the families in calling for this to be urgently progressed so that they can seek redress and accountability.
